Customer Terms & Conditions for Tyres, Mechanical Repairs & Vehicle Services
Effective Date: 23rd June 2026
These Terms & Conditions apply to all services provided by Capricorn Tyre & Mechanical (“Capricorn”, “we”, “us”, “our”), including but not limited to tyres, mechanical repairs, servicing, inspections, diagnostics, wheel alignments, call-outs, supply of parts, and other vehicle-related services.
By requesting, approving, or accepting work from Capricorn Tyre & Mechanical, the customer (“you”, “your”) acknowledges and agrees to these Terms & Conditions.
1. Quotes & Estimates
- Quotes provided by Capricorn are based on the information available at the time of assessment.
- Quotes are valid for 30 days unless otherwise stated.
- Quotes may change where additional faults, damaged components, or unexpected issues are identified during inspection or repairs.
- Capricorn will communicate additional work where reasonably practical and seek approval before proceeding.
- Diagnostic assessments may identify further faults that cannot be confirmed until additional testing, dismantling, or inspection is completed.
2. Authorisation to Carry Out Work
- By approving work verbally, electronically, in writing, or by signing a job card, the customer authorises Capricorn to carry out the agreed services.
- The customer acknowledges that additional faults may be identified during servicing, repairs, inspections, or diagnostics.
- Where additional repairs or parts are required, Capricorn will seek approval where practical before proceeding.
- The customer remains responsible for any authorised work, labour, inspections, or diagnostic charges incurred.
3. Mechanical Repairs & Diagnostics
- Diagnostic services are charged for the time, equipment, resources, and technical expertise required to identify faults.
- A diagnostic result does not guarantee that all faults have been identified without further testing or repairs.
- Repairs may uncover additional issues due to vehicle age, condition, previous repairs, modifications, or hidden faults.
- Capricorn is not responsible for pre-existing faults or issues unrelated to the work completed.
- Customers acknowledge that mechanical repairs and diagnostics may require further investigation before a complete assessment can be provided.
4. Minimum Labour Charge & Inspection Fees
- Capricorn may apply a minimum labour charge for inspections, assessments, testing, diagnostics, and repair work undertaken.
- Inspection or diagnostic charges may apply regardless of whether repairs are approved or completed.
- Charges cover the time, equipment, and technical expertise required to assess the vehicle.
- If further investigation is required, additional labour charges may apply.
- Customers will be advised where possible before additional diagnostic time is undertaken.
- If the customer chooses not to proceed with repairs after diagnosis or inspection, the customer remains responsible for applicable charges incurred.
- Capricorn may charge for labour already completed, including testing, dismantling, assessment, partial repairs, and reassembly.
5. Vehicle Testing & Road Testing
- Capricorn may require a vehicle to be inspected, operated, tested, or road tested as part of diagnostics, repairs, servicing, tyre fitting, wheel alignment, safety checks, or verification of completed work.
- By authorising work, the customer gives permission for Capricorn employees or authorised persons to operate the vehicle where required.
- Road testing may be required to confirm faults, verify repairs, assess vehicle performance, or ensure the vehicle is operating correctly.
- Capricorn will take reasonable care during testing; however, customers acknowledge that existing faults, worn components, vehicle age, previous damage, or pre-existing conditions may become apparent during testing.
- Capricorn is not responsible for failures or faults caused by existing vehicle conditions unrelated to the services provided.
- If additional faults are identified during testing, further inspection, parts, labour, or diagnostic charges may apply.
- Capricorn reserves the right to refuse road testing where a vehicle is considered unsafe or not suitable for operation.
- Where a vehicle cannot safely be driven, alternative testing methods may be used where available.
6. Additional Charges
Capricorn reserves the right to apply additional charges where required to complete authorised work or where circumstances outside Capricorn’s reasonable control occur.
Additional charges may include, but are not limited to:
- Additional labour required due to unexpected faults, seized components, damaged parts, incorrect information provided, or conditions not visible during initial assessment.
- Additional diagnostic charges where further testing, equipment, or specialist knowledge is required.
- Parts sourcing charges where additional time is required to locate, order, collect, or arrange delivery of parts.
- Special order parts that are ordered specifically for a customer or vehicle may require payment prior to ordering and may be subject to supplier return policies.
- Cancellation charges where parts have been ordered, labour has commenced, or workshop time has been allocated.
- Vehicle storage fees where vehicles are not collected within a reasonable timeframe after completion and notification.
- Cleaning or disposal charges where excessive dirt, waste, hazardous materials, or unsafe conditions require additional handling.
- Recovery, towing, or transport charges where vehicles require movement or cannot be safely driven.
- Call-out fees including travel time, attendance, labour, and equipment costs for mobile services.
- After-hours or urgent service charges where work is requested outside normal operating hours or requires priority scheduling.
- Bank fees, administration fees, and recovery costs associated with overdue accounts or failed payments.
Where practical, Capricorn will advise the customer of additional charges before proceeding. By approving additional work or allowing work to continue, the customer agrees to be responsible for applicable charges.
7. Parts & Components
- Parts supplied by Capricorn may include genuine, aftermarket, or customer-approved alternative parts depending on availability and customer requirements.
- Parts supplied by Capricorn are covered by applicable manufacturer warranties where available.
- Capricorn is not responsible for manufacturer warranty limitations or exclusions.
- Removed parts may be retained for inspection if requested by the customer prior to disposal.
- Special order parts may not be returnable or refundable where they have been ordered specifically for the customer or vehicle.
8. Tyres & Wheel Services
- Customers are responsible for ensuring correct tyre selection where specific tyres, sizes, brands, or specifications are requested.
- Capricorn will provide recommendations based on available information, vehicle requirements, and manufacturer guidelines.
- Tyres must be used in accordance with manufacturer recommendations, including correct load ratings, pressures, and operating conditions.
- Capricorn is not responsible for tyre failure caused by misuse, incorrect inflation, damage, road conditions, or factors outside Capricorn’s control.
- Wheel alignment results may vary depending on vehicle condition, suspension components, steering components, modifications, and pre-existing faults.
- Capricorn may recommend additional repairs where worn or damaged components prevent correct alignment or safe operation.
9. Service Call Outs & Field Work
- Call-out services are charged based on travel, labour, equipment, materials, and time required.
- Additional repairs identified onsite may require approval before completion.
- Customers must provide safe access and suitable working conditions for mobile services.
- Capricorn reserves the right to refuse work where conditions are unsafe or unsuitable.
10. Customer Responsibilities
The customer agrees to:
- Provide accurate information regarding the vehicle, faults, history, and requirements.
- Inform Capricorn of any known issues, modifications, previous repairs, or concerns.
- Ensure the vehicle is legally able to be driven unless otherwise agreed.
- Remove personal belongings from the vehicle before leaving it with Capricorn.
- Follow any recommendations provided by Capricorn regarding repairs, maintenance, safety concerns, or vehicle operation.
11. Payment Terms
- Payment is required upon completion of work unless prior approved account arrangements have been made.
- Capricorn accepts payment by approved payment methods.
- The customer is responsible for payment of all authorised labour, parts, services, inspections, diagnostics, and additional charges.
- Accounts must be paid within the agreed trading terms.
- Outstanding amounts may result in account suspension, recovery action, and/or referral to debt collection.
- Any costs associated with recovering outstanding debts may be charged to the customer where permitted by law.
12. Accounts & Credit Customers
- Credit accounts are available only upon approval by Capricorn.
- Customers with approved accounts agree to pay invoices within the agreed trading terms.
- Capricorn reserves the right to review, change, or withdraw credit facilities at any time.
- Capricorn may suspend further work or services where an account is overdue.
- Credit customers must notify Capricorn of any changes to business details, ownership, or contact information.
13. Vehicle Collection & Storage
- Customers will be notified when their vehicle is ready for collection.
- Vehicles must be collected within a reasonable timeframe after notification.
- Storage fees may apply where a vehicle remains onsite after completion and the customer has been notified.
- Capricorn reserves the right to charge additional costs associated with vehicles left onsite for extended periods.
- Capricorn is not responsible for personal items left inside vehicles.
- Customers must ensure all vehicles are collected and payment obligations are finalised before release.
14. Retention of Title
14.1 Ownership of Goods
- Any goods supplied by Capricorn Tyre & Mechanical (“Capricorn”) remain the property of Capricorn until all amounts owing by the customer for goods and services have been paid in full.
- Payment is only considered received once funds have cleared and are available to Capricorn.
14.2 Customer Responsibilities Until Ownership Transfers
Until ownership of the goods passes to the customer:
- The customer must take reasonable care of the goods and ensure they are not damaged, altered, removed, or disposed of without Capricorn’s approval.
- The customer acknowledges they hold the goods as a bailee for Capricorn until payment has been received in full.
- The customer must not sell, transfer, or dispose of unpaid goods unless authorised by Capricorn.
- If unpaid goods are sold in the ordinary course of business, any proceeds received must be held on trust for Capricorn until payment is made.
- Capricorn may request the return of unpaid goods where payment has not been received.
- The customer authorises Capricorn to take reasonable steps to recover goods where legally permitted.
- Capricorn retains the right to recover payment for goods supplied regardless of whether ownership has transferred.
15. Defects, Warranties, Returns & Australian Consumer Law
15.1 Inspection & Notification
- Customers must inspect goods supplied and services completed by Capricorn upon completion or delivery.
- Any concerns relating to defects, damage, incorrect goods supplied, shortages, or workmanship issues must be notified to Capricorn within a reasonable timeframe.
- Customers must allow Capricorn the opportunity to inspect and assess any concern before repairs, adjustments, or rectification work are completed by another party.
15.2 Warranty & Consumer Rights
- Capricorn complies with the Australian Consumer Law and applicable consumer guarantees.
- Nothing in these Terms & Conditions excludes, restricts, or modifies any rights that cannot legally be excluded.
- Capricorn does not provide additional warranties unless specifically agreed in writing.
- Manufacturer warranties may apply to supplied parts and products and are subject to manufacturer terms and conditions.
15.3 Warranty Exclusions
Capricorn is not responsible for defects, damage, or failures caused by:
- Incorrect use, misuse, or operation of the vehicle or goods.
- Failure to properly maintain the vehicle or goods.
- Continued use after a fault, warning sign, or defect has been identified.
- Modifications, repairs, or work completed by another party.
- Normal wear and tear, accidents, or circumstances outside Capricorn’s reasonable control.
15.4 Returns
Returns will only be accepted where:
- The customer has notified Capricorn within a reasonable timeframe.
- Capricorn has inspected and agreed the goods are defective or incorrect.
- Goods are returned in a condition suitable for assessment.
- The return complies with applicable supplier or manufacturer requirements.
Special order, customised, fitted, used, or customer-specific goods may not be accepted for return unless required by law.
16. Compliance with Laws & Regulations
- Capricorn will carry out services in accordance with applicable Australian laws, regulations, industry standards, and reasonable workplace practices.
- Customers are responsible for ensuring their vehicle complies with registration, roadworthiness, insurance, and legal requirements.
- Capricorn may refuse work where a vehicle, parts, modifications, instructions, or requested repairs may be unsafe, unlawful, or non-compliant.
- Where safety issues, defects, illegal modifications, or risks are identified, Capricorn may notify the customer and recommend appropriate action.
- Customers acknowledge Capricorn is not responsible for existing defects, modifications, or conditions present before the vehicle is supplied for service.
17. Privacy Policy
17.1 Collection of Information
Capricorn Tyre & Mechanical (“Capricorn”) may collect personal information from customers to provide services, process bookings, complete repairs, communicate regarding vehicles, issue invoices, manage accounts, and meet legal obligations.
Information collected may include:
- Customer name and contact details.
- Vehicle details including registration, make, model, and service history.
- Information required to provide requested services.
- Account and payment information where applicable.
17.2 Use of Information
Customer information may be used for purposes including:
- Providing tyre, mechanical, servicing, diagnostic, and repair services.
- Contacting customers regarding vehicles, quotes, repairs, appointments, invoices, and service reminders.
- Maintaining service records.
- Managing customer accounts and payments.
- Improving customer service and business operations.
- Providing relevant promotions, offers, or updates where consent has been provided.
17.3 Disclosure of Information
Capricorn will only use and disclose customer information where reasonably required to provide services or where permitted or required by law.
Information may be shared with:
- Suppliers or manufacturers where required for warranty claims or parts.
- Service providers assisting with business operations.
- Authorities where required by law.
Capricorn does not sell customer personal information to third parties.
17.4 Storage & Security of Information
Capricorn takes reasonable steps to protect customer information from misuse, loss, unauthorised access, modification, or disclosure.
Customer information may be stored electronically or in physical records and retained only for as long as reasonably required for business, legal, accounting, and warranty purposes.
17.5 Customer Access
Customers may request access to personal information held by Capricorn and request corrections where information is inaccurate or outdated.
Requests can be made by contacting Capricorn Tyre & Mechanical.
17.6 Marketing Communications
From time to time, Capricorn may contact customers regarding services, promotions, reminders, or offers.
Customers may request to stop receiving marketing communications at any time.
18. Liability
- Capricorn takes reasonable care when handling customer vehicles, goods, and property.
- Capricorn is not responsible for loss, damage, or failure caused by circumstances outside Capricorn’s reasonable control.
- Capricorn is not responsible for faults, failures, or damage caused by pre-existing vehicle conditions, previous repairs, modifications, misuse, or lack of maintenance.
- Customers acknowledge that older vehicles, modified vehicles, and vehicles with existing faults may experience additional issues during or after repairs.
- Nothing in these Terms & Conditions excludes any rights or guarantees that cannot legally be excluded under Australian Consumer Law.
19. General Terms
19.1 Dispute Resolution
If a dispute arises regarding these Terms & Conditions or services provided by Capricorn, both parties agree to first attempt to resolve the matter through good faith discussion.
Where required, either party may request mediation by providing written notice outlining the dispute.
The costs of mediation will be shared equally unless otherwise agreed.
If the dispute cannot be resolved through mediation, either party may pursue other available legal remedies.
19.2 No Waiver & Severability
If either party does not enforce any provision of these Terms & Conditions, this does not waive their right to enforce that provision in the future.
If any part of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply.
19.3 Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
The parties agree to submit to the jurisdiction of the Queensland courts.
These Terms & Conditions apply over any terms provided by the customer, including purchase orders or other documents, unless otherwise agreed by Capricorn in writing.
19.4 Limitation of Liability
To the maximum extent permitted by law, Capricorn is not liable for indirect, consequential, or economic loss, including loss of income, profit, or business opportunities arising from the supply of goods or services.
19.5 Assignment
Capricorn may transfer or assign its rights or obligations under these Terms & Conditions where required for business purposes.
The customer may not transfer or assign their rights or obligations without Capricorn’s prior written approval.
19.6 Subcontractors
Capricorn may engage subcontractors or third parties to assist with providing goods or services.
Capricorn remains responsible for its obligations under these Terms & Conditions.
Customers must not provide instructions directly to Capricorn’s subcontractors without Capricorn’s approval.
19.7 Changes to Terms & Conditions
Capricorn may update these Terms & Conditions from time to time.
Updated terms will apply to future services or transactions once provided to the customer or accepted by the customer.
19.8 Force Majeure
Capricorn is not responsible for delays, failures, or inability to provide services due to events outside of its reasonable control, including:
- Natural disasters.
- Fire, flood, or storms.
- Government restrictions.
- Industrial action.
- Supply shortages.
- Pandemics.
- Transport delays.
- Other unforeseen events.
This does not remove the customer’s obligation to pay any amounts owing to Capricorn.
19.9 Authority to Enter Agreement
Both parties confirm they have the authority and capacity to enter into these Terms & Conditions and that these Terms & Conditions create a valid agreement between the parties.
19.10 Survival of Obligations
Any obligations intended to continue after completion of services, including payment obligations, warranties, and liability provisions, remain enforceable after completion of any transaction.
20. Customer Acceptance
By:
- Approving work verbally, electronically, or in writing;
- Leaving a vehicle with Capricorn Tyre & Mechanical;
- Accepting a quote;
- Signing a job card; or
- Requesting services,
the customer acknowledges they have read, understood, and accepted these Terms & Conditions.
